It doesn’t matter whether Macmillan wins the price-fixing lawsuit bought by the Department of Justice. The point is, the big six publishers’ Plan B for fighting the emerging Amazon monopsony has failed (insofar as it has been painted as a price-fixing ring, whether or not it was one in fact). This means that they need a Plan C. And the only viable Plan C, for breaking Amazon’s death-grip on the consumers, is to break DRM.

If the major publishers switch to selling ebooks without DRM, then they can enable customers to buy books from a variety of outlets and move away from the walled garden of the Kindle store. They see DRM as a defense against piracy, but piracy is a much less immediate threat than a gigantic multinational with revenue of $48 Billion in 2011 (more than the entire global publishing industry) that has expressed its intention to “disrupt” them, and whose chief executive said recently “even well-meaning gatekeepers slow innovation” (where “innovation” is code-speak for “opportunities for me to turn a profit”).

And so they will deep-six their existing commitment to DRM and use the terms of the DoJ-imposed settlement to wiggle out of the most-favoured-nation terms imposed by Amazon, in order to sell their wares as widely as possible.

If they don’t, they’re doomed. And all of us who like to read (or write) fiction get to live in the Amazon company town.

Caro had a further epiphany about power in the early ’60s. He had moved on to Newsday by then, where he discovered that he had a knack for investigative reporting, and was assigned to look into a plan by Robert Moses to build a bridge from Rye, N.Y., across Long Island Sound to Oyster Bay. “This was the world’s worst idea,” he told me. “The piers would have had to be so big that they’d disrupt the tides.” Caro wrote a series exposing the folly of this scheme, and it seemed to have persuaded just about everyone, including the governor, Nelson Rockefeller. But then, he recalled, he got a call from a friend in Albany saying, “Bob, I think you need to come up here.” Caro said: “I got there in time for a vote in the Assembly authorizing some preliminary step toward the bridge, and it passed by something like 138-4. That was one of the transformational moments of my life. I got in the car and drove home to Long Island, and I kept thinking to myself: ‘Everything you’ve been doing is baloney. You’ve been writing under the belief that power in a democracy comes from the ballot box. But here’s a guy who has never been elected to anything, who has enough power to turn the entire state around, and you don’t have the slightest idea how he got it.’ ”

The lesson was repeated in 1965, when Caro had a Nieman fellowship at Harvard and took a class in land use and urban planning. “They were talking one day about highways and where they got built,” he recalled, “and here were these mathematical formulas about traffic density and population density and so on, and all of a sudden I said to myself: ‘This is completely wrong. This isn’t why highways get built. Highways get built because Robert Moses wants them built there. If you don’t find out and explain to people where Robert Moses gets his power, then everything else you do is going to be dishonest.’ ”

It turns out that the act of summoning the past to the surface actually changes the memory itself. Although we’ve long imagined our memories as a stable form of information, a data file writ into the circuits of the brain, that persistence is an illusion. In reality, our recollections are always being altered, the details of the past warped by our present feelings and knowledge. The more you remember an event, the less reliable that memory becomes. And this returns us to the problem of eyewitness testimony. Eyewitnesses are repeatedly asked to recall what they saw, but their answers are inevitably influenced by the questions being asked. The result is more confidence in increasingly less accurate testimony.
One who will not allow any occurrence whatever to deprive him of his responsibility for the course of history—because he knows that it has been laid on him by God—will thereafter achieve a more fruitful relation to the events of history than that of barren criticism and equally barren opportunism. The ultimate question for a responsible man to ask is not how he is to extricate himself heroically from the affair, but how the coming generation is to live. Charles Marsh is speaking at the Wheaton College chapel this morning about one of the great Christian witnesses of the past century, Fannie Lou Hamer of Ruleville, Mississippi.

I’ve always thought that conservatives should simply bite the bullet and admit that there are racists among self-described conservatives, and moreover, that these conservatives’ racism is an evitable (that is, unwarranted) extension of the mainstream conservative position on race. But this is true in the same way it is true that there are communists among self-described liberals, and that their communism is an evitable (that is, unwarranted) extension of the mainstream liberal position on political economy. To put this even more forcefully, we have to yield that there is something to it when liberal trolls snark about how tough it can be to distinguish a conservative from a racist. The fact is that both conservatives and racists think that considerations about race should play a much smaller part in our political discourse.

As a person with what I believe to be deep conservative sympathies, I read something like this and think, Well, I guess I’m not a conservative at all, then. In what sense, and for what reasons, is it intrinsic to conservatism to believe that “considerations about race should play a much smaller part in out political discourse”? What’s conservative about that view? Notice that Foster is not even saying that conservatives have to hold a particular view about race, only a view about how much race is discussed. Are we not supposed to discuss it very much because racism is not and never has been a big problem in America? Or because racism used to be a big problem but now it has been effectively solved? Or what? Someone please explain to me what makes talking about race in America incompatible with conservatism.

In my text drawings I deconstruct the word of God by cutting letters from sacred writings and rearranging them to form a passage from another holy book. I may cut letters from the Bible and reassemble them as a passage from the Koran, or use letters cut from the Torah to recreate an ancient Tantric text. The individual letters are glued to the paper in a continuous line of type, without spaces or punctuation, in order to discourage a literal reading of the text.
